I. BASIC CONCEPTS 1.1. Online Store – this online store located at siphouse.ie. 1.2. Account – The Buyer’s user account in the Online Store, intended for shopping in the Online Store. 1.3. Seller – SIPS House LTD, headquarters 28 Baggot Street Lower, Dublin 2, Ireland 1.4. Buyer – a capable natural person whose capacity is not limited by court order, as well as a legal entity or duly authorized representatives of the mentioned persons. 1.5. Construction product/Product – SIP houses, modular houses, garden houses, wooden houses, garages, saunas, hot tubs, and other products sold in the Seller’s Online Store. 1.6. Contract – a purchase-sale contract for the Product with a selected set of materials concluded between the Buyer and the Seller when the Buyer shops in the Online Store. 1.7. Rules – these General rules for the purchase and sale of electronic commerce products. 1.8. Other rules – any other rules, procedures, policies, or legal documents of a different nature required by the laws of the Republic of Ireland or necessary to establish clear rights and obligations of the Buyer and Seller to successfully complete a purchase using the Online Store. 1.9. Order – Products with a selected set of materials ordered by the Buyer in the Online Store. 1.10. Parties – the Buyer and the Seller together. II. GENERAL PROVISIONS II.1. These Rules ensure the rights of the Buyer and the Seller, set the obligations, responsibilities, and other rules related to the purchase and sale of products in the Online Store. The Rules set the conditions and procedures for ordering, purchasing, returning goods in the Online Store, and the procedure for payment for construction products. II.2. Before purchasing the Seller’s products, the Buyer must confirm that they are familiar with and agree with: II.2.1. The general rules for the purchase and sale of electronic commerce products; II.2.2. Privacy policy; II.2.3. Product delivery and return procedure; II.2.4. Other rules, which are published on the Seller’s website and are requested to be reviewed during the purchase. II.3. The Buyer can mark their consent or dissent with the respective uses of the Buyer’s personal data in the manner provided by the Online Store. More about this can be found in the Privacy Policy. II.4. The Product Delivery conditions, Payment methods, Warranty, and return rules published on the Online Store website are integral parts of these Rules, with which the Buyer must familiarize themselves before concluding the Contract. II.5. By purchasing in the Online Store and marking the checkbox next to the statement “I have read and agree to the purchase rules and privacy policy,” the Buyer confirms that they have familiarized themselves with these Rules, agrees with them, and undertakes to comply with them. Once the Buyer confirms the Rules, they become an integral part of the Contract. II.6. The Seller assumes no risk or responsibility and is unconditionally and maximally exempted from it to the extent permitted by law if the Buyer has not familiarized themselves with the Rules, although they had the opportunity to do so.
II.7. Contracts in the Online Store are concluded in electronic form. The Seller, when concluding Contracts with Buyers, follows the provisions of the Civil Code of the Republic of Ireland governing distance contracts, as well as other legal acts of the Republic of Ireland regulating the purchase of Construction products. II.8. The Seller reserves the right to unilaterally change the Rules at any time, announcing the amended Rules on the Online Store website. The amendments come into force from the moment of publication and apply to all transactions concluded after the publication. II.9. All capable natural persons whose capacity is not limited by court order, as well as legal entities or duly authorized representatives of the mentioned persons, can buy products in the Online Store. II.10. Trade in the Online Store is conducted in the Republic of Ireland. Product delivery is also possible to other European Union/Schengen countries, with the Countries agreeing on the Product delivery conditions. II.11. The Seller has the right to temporarily or indefinitely suspend (terminate) the operation of the Online Store without informing the Buyer. III. ONLINE STORE ACCOUNT III.1. The Buyer can purchase Products and materials in the Online Store by creating an individual Account or by submitting an Order without creating an Account. III.2. Upon successful registration, an individual Account is created, to which the Buyer can log in only by entering the email address and password used during registration. III.3. During registration in the Online Store, when filling out the order form, or otherwise using the Online Store, the Buyer must provide detailed and correct information. If the data provided by the Buyer changes, the Buyer must update them immediately. The Buyer is responsible for the accuracy of the data provided in the registration form, order form, or otherwise using the Online Store and assumes responsibility for the consequences arising from the inaccuracy or inaccuracy of the provided data. III.4. The Buyer has the right to change and supplement data in their Account at any time or submit a request to the Seller to delete their Account. III.5. The Buyer undertakes to ensure the confidentiality of the Account data and password and not to disclose them to third parties. The Buyer is responsible for storing the login data provided to them, as well as for any actions performed in the Online Store after logging into the Buyer’s Account. The Buyer is responsible for any third-party actions if they were performed using the Buyer’s login data and/or the Buyer’s Account. III.6. The Buyer undertakes to closely monitor their email so that they can pay attention to the information sent by the Seller in time. IV. PAYMENT FOR PRODUCTS IV.1. Payment for Products is possible using bank transfers or credit card payments through the PAYSERA platform. IV.2. The VAT invoice for the Buyer is presented by email after the Product, materials, or construction works are picked up (delivered). IV.3. If an advance or full payment for the Product is not made, it is considered that the Contract has not been concluded. IV.4. The Seller undertakes to provide the Buyer with all necessary and correct information necessary for the payment of Products and their delivery services but assumes no responsibility for improper services provided by banks used by the Buyer to make payments to the Seller and related losses. Also, the Seller assumes no responsibility for errors made by the Buyer in forming and executing the payment order (e.g., incorrect account number indication and/or entry, incorrectly presented order code, etc.) and related losses and/or other negative consequences. IV.5. Due to changing raw material prices, the final product price may differ from the one presented in the Online Store. You will receive the most accurate information about the final offer by contacting our sales manager Tomas. V. ORDER EXECUTION AND PRODUCT DELIVERY. WARRANTIES V.1. When ordering Products with a selected set of materials, the Buyer must specify the delivery address. V.2. The Order starts to be executed after the Buyer pays the advance or the full amount for the Products and their delivery and the money reaches the Seller’s bank account. V.3. The Buyer undertakes to accept the Products personally or legally authorize another person, informing the Seller about this. This information is indicated at the time of Order submission. V.4. Product delivery is already included in the Product price, so no additional fee is charged, except in the cases provided for in these Rules. V.5. 3-4 days before the Product delivery, the exact time of Product delivery is agreed with the Buyer by phone or email. V.6. The Seller takes care of unloading the Product at the address specified by the Buyer. The Buyer must ensure that the place where the Product is to be delivered is easily accessible. Otherwise, the Product with a set of materials or an already fully prepared Product will not be delivered to the address specified by the Buyer. The Seller will charge a set fee for repeated delivery. V.7. For Product delivery to another country, the Buyer must contact the Seller to agree on the conditions. V.8. If the Buyer wishes, the Seller can offer other Products or services related to the sale, finishing, and installation of cabins not presented in the Electronic Store assortment. The ordering of such Products and services is agreed with the Buyer individually, by contacting by phone +37064317137 or email info@siphouse.ie V.9. After making a purchase in our Online Store, the Buyer will receive a notification of the Order confirmation to their specified email. Only after receiving confirmation from the Seller by email will it be considered that the Parties have concluded a Product purchase-sale contract for the purpose of purchasing our offered Product under the terms specified in the Contract. If, after placing the Order and transferring the payment, the final amount changes due to changing raw material prices or additional product accessories and other requests (type of windows, doors, etc.), we will inform you by email. In this case, you will have to cancel the Contract within 3 working days, the Order will not be started, and the paid amount will be refunded within 14 calendar days from the day of cancellation of the Contract. V.10. After agreeing on the conditions for changing the price, the Seller will start executing the Order, and from this moment the Parties will have rights and obligations provided in the Contract. V.11. The standard product manufacturing time is from 6 to 8 weeks if you choose a Product from our offered sample catalog in the Online Store. If the Buyer orders a custom Product with specific Buyer requests, the product manufacturing time can be from 8 to 12 weeks. Product delivery terms may change depending on production occupancy, so the final Product delivery term is specified in the Contract. V.12. All materials and Products ordered from us are subject to a 5-year warranty. If the Buyer orders a Product with construction works, the Seller also provides a 5-year warranty for these construction works from the day of the acceptance-transfer act of these construction works. V.13. If the minimum period during which the Product will be manufactured is 2 months, and the Buyer cancels the Order no later than 1 month from the date of Order submission, in this case, 20% of the paid advance or _____% of the total amount paid for the Product is refunded. After 1 month from the date of Order submission, the paid amounts are not refunded. V.14. At the time of Product delivery, the Buyer must check the condition of the Product with the selected set of materials, the assortment of Products, quantity, and quality. Product external appearance damages, Product assortment and/or quantity discrepancies, the Buyer must note together with the Seller’s representative in the damage/discrepancy act. Damages/discrepancies recorded at the time of Product transfer are rectified by the Buyer and Seller in an agreed manner and terms. If the Seller performs construction works of the Product, the Product transfer is carried out after the completion of the construction works. VI. BUYER’S RIGHTS AND OBLIGATIONS VI.1. The Buyer has the following rights: VI.1.1. Buy Products with a selected set of materials in the Seller’s Online Store siphouse.ie according to the procedure established by these Rules; VI.1.2. cancel the Order according to the procedure established by the Rules; VI.1.3. cancel the Contract according to the procedure established by the Rules; VI.1.4. change or return purchased Products, materials according to the procedure established by the Rules. VI.1.5. other rights provided for in these Rules, the Privacy Policy, and the legal acts of the Republic of Ireland. VI.2. The Buyer undertakes: VI.2.1. When purchasing in the Seller’s Online Store, the Buyer must fulfill their obligations, comply with these Rules, the Privacy Policy, the Contract terms, and other conditions clearly indicated by the Seller, and not violate the legal acts of the Republic of Ireland; VI.2.2. pay for the Ordered Products and materials and accept them according to the procedure established by these Rules. VI.2.3. If the data provided by the Buyer in the Order form changes, immediately inform the Seller by email. VI.2.4. If the Buyer, at the time of Product delivery, without significant reasons, refuses to accept the Product or other assembled materials, the Buyer must cover the Product or material delivery expenses. VI.2.5. not transfer their login data to third parties. If the Buyer loses the login data, they must immediately inform the Seller using the contact means indicated in the “Contacts” section. VII. SELLER’S RIGHTS AND OBLIGATIONS VII.1. The Seller has the right to change, suspend or terminate the operation of certain functions of the Online Store or part of them, as well as change the layout of elements on the site. VII.2. The Seller has the right to suspend or terminate the operation of the Online Store. In this case, all accepted and confirmed Buyers’ Orders are completed, and new orders are not accepted. VII.3. If the conditions for providing services change significantly (e.g., market conditions, changes in legal acts, etc.), the Seller has the right to change the offered Product range, scope, or method. Suspend, terminate the provision of services or part of them, charge additionally for arising services or part of services. If the Buyer expresses disagreement with the changed conditions, their order is canceled, and the paid sums are refunded according to the procedure established by the Rules. VII.4. The Seller has the right to cancel the Buyer’s order without prior notice to the Buyer, if: VII.4.1. The Seller fails to contact the Buyer within 2 (two) working days after the order submission; VII.4.2. The Buyer does not provide the Seller with the requested information within the term specified by the Seller; VII.4.3. if the Buyer does not provide the Seller with consent for his personal data processing.
VII.5. The Seller has the right to refuse the Buyer’s submitted Order if the Buyer’s desired Product or material stocks are exhausted, or if the Order is submitted by a person who, according to these Rules, had no right to submit it. VII.6. The Seller has other rights enshrined in these Rules, the Privacy Policy, other Company documents, and the legal acts of the Republic of Ireland. VIII. SELLER’S OBLIGATIONS VIII.1. The Seller undertakes to respect the Buyer’s privacy, process the Buyer’s Personal data only according to the procedure established by the Rules, the Privacy Policy, in compliance with the European Union General Data Protection Regulation, the provisions of the legal acts of the Republic of Ireland. VIII.2. According to the conditions provided in the Rules, the Seller undertakes to provide the Buyer with ordered and accept returned Products and materials. VIII.3. If the Seller, due to important circumstances, cannot provide the Buyer with the ordered Product or material, he undertakes to offer the Buyer an analogous or as similar as possible Product or material. If the Buyer refuses to accept the Product that was offered as analogous or similar, the Seller undertakes to refund the Buyer the paid money within 14 (fourteen) working days if an advance payment was made, and in all cases, cancel the order. VIII.4. To examine the Buyer’s submitted written reasoned complaints within 20 calendar days of their receipt. VIII.5. The Seller undertakes to fulfill other obligations imposed on the Seller in the Rules, the Privacy Policy, and the legal acts of the Republic of Ireland. IX. PROTECTION OF PERSONAL DATA IX.1. The Seller applies the requirements for the processing of personal data established in the Law on Legal Protection of Personal Data of the Republic of Ireland and the European Union General Data Protection Regulation. IX.2. The Seller takes appropriate technical and organizational measures to ensure the protection of all processed personal data from accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, and all other unlawful forms of processing. IX.3. More information about the Buyer’s personal data processing can be found in the Seller’s Online Store privacy policy. X. FINAL PROVISIONS X.1. These Rules are drawn up following the legal acts of the Republic of Ireland. X.2. The law of the Republic of Ireland applies to the relationships arising under these Rules. X.3. All disputes arising from the execution of these Rules are resolved by negotiation. If unsuccessful, disputes are resolved according to the procedure established by the legal acts of the Republic of Ireland.
